Terms & Conditions

To be an authorized affiliate of Wealth Creation Affiliate(WCA) and Online Sales Systems (OSS), you agree to abide by the terms and conditions contained in this agreement.

Please read this agreement carefully before registering and using the Wealth Creation Affiliate (WCA) service as an affiliate. By signing up for the WCA affiliate program, or any of its affiliates programs, you indicate your acceptance of this agreement and its terms and conditions.

  1. Term of the Agreements and Policies: The terms of this Agreement in conjunction with our Affiliate Policy will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. You are only eligible to earn referral fees on sales occurring during the term.

  2. Modification: We may modify any of the terms and conditions contained in this Agreement, at any time and at our sole discretion. Modifications may include, for example, changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE PROGRAM WILL CONSTITUTE BINDING ACCEPTANCE OF ANY CHANGES.

  3. Limitation of Liability: We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement.

  4. Independent Investigation: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.

  5. Miscellaneous: This Agreement will be governed by the laws of Australia, without reference to rules governing choice of laws. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

  6. Copyrights: The affiliate ad copy provided within this program has been originally authored by us, or our affiliated partners, and we retain all legal copyrights. Any misuse of any portion of our graphics, ad copy, and other materials owned by our company outside of our terms or for any other reason unassociated to our affiliate program is considered copyright infringement and can be legally pursued as such. You agree to use our material only within our terms, specifically and exclusively for this affiliate program.

  7. Should you choose to lease the domain name (URL) from Wealth Creation Affiliate (hereafter referred to as WCA), the domain name remains at all times the property of WCA or it’s affiliated partners. You have use of the domain within the boundaries of the WCA Program while you are on a WCA supplied hosting package. On termination of said package, WCA will retain the domain name and can make the domain available to anyone else. WCA may at times choose to lease domain names from other providers and sublease them to its customers..

  8. WCA provides commissionable products for sale on the affiliate websites. All commissions are paid by the companies and businesses that own the programs. Whilst WCA does its due diligence on the providers and ensures a high standard of payment ethics are upheld, WCA cannot and will not be held responsible for any unpaid commissions should such an unlikely situation occur. Any disputes of commission payment must be directed directly to the owner of the commissionable product. WCA is adamant of upholding a high standard and will only accept credible products and good reliable payers. All commisions are inclusive of GST within Australia and are excluded of GST outside of Australia.

  9. Sales and leads are tracked by a cookie placed on the web surfers computer. The first WCA site they click through to order a dvd, request an ebook or purchase a product will remain the lead of the first referring site. This is tracked electronically. WCA or OSS will not be held responsible for users deleting their cookies or bypassing the system by going direct to the product seller. Some of our providers do however investigate every sale and follow up on the possibility of a commission being payable. If a referrer is established, a commission is made payable at the agreed rate. All commissions are subject to payment once the money back guarantee has expired.

  10. Third party affiliate products. If any affiliate products, outside of the WCA and OSS agreement are added to the affiliate websites, unless approved in writing by WCA, then WCA and OSS reserve the right to terminate the agreement.
